In the United States, the Copyright Office says material generated entirely by AI is not protected by copyright, prompts alone do not make the user its author, and copyright may cover human-authored parts of a mixed work. A platform’s permission to use a track and your ability to claim copyright in it are separate questions.
What Copyright Protects In AI-Generated Audio
The U.S. Copyright Office’s January 2025 report says a work created entirely by AI is not copyrightable. Writing prompts—even detailed ones—does not by itself make the prompter the author. If a work combines generated audio with human-authored material, only the human-authored contribution may be protected. U.S. Copyright Office report and guidance

For a registration application that includes more than a minimal amount of AI-generated material, applicants must disclose that material and describe their own contribution. Keep project files and notes that show what you wrote, performed, arranged, edited, or otherwise contributed; the cited guidance establishes the disclosure requirement, not that any particular workflow guarantees copyright protection.
Check These Rights Before You Publish
- Service license: Read the terms for the specific account tier and track. A vendor’s commercial-use statement is not the same as a promise that the track qualifies for copyright protection.
- Voices and identity: Get permission before using or imitating an identifiable person’s voice. Spotify says vocal impersonation on its service is allowed only when the impersonated artist authorized it. That is Spotify’s policy; check the rules of every service where you plan to release the audio. Spotify AI protections announcement
- Covers and samples: A generator’s license does not establish that you have permission for a borrowed composition, recording, sample, or recognizable melody. Check the service’s terms and obtain any permissions needed for the material you supply or reproduce.
- Platform disclosure and monetization: YouTube requires disclosure for realistic altered or synthetic content that could be mistaken for a real person’s performance. Its inauthentic-content policy targets mass-produced, repetitive, or template-based uploads, rather than AI use by itself. Spotify announced AI Persona badges for artist identities that may be AI-generated, and supports AI disclosures in credits. Check current platform rules when uploading. These statements describe the services’ published claims and limitations in the supplied product information. They are not a legal determination that a particular track is cleared, copyrightable, or safe for every use. Confirm the current terms for your plan and intended release before relying on a license.

| Service | Published rights information | What to verify |
|---|---|---|
| Suno | Paid subscriber-created songs are described as yours to keep and use; the Free Plan does not include commercial rights. | Confirm your account tier and the applicable terms for the track. |
| Eleven Music | Tracks are described as cleared for broad commercial use, but rights vary by subscription tier; the stated limitations exclude film, TV, and studio games. | Check the tier and whether your specific project falls within the permitted use. |
| Loudly | The service advertises a commercial license; its product information says paid licensing rights depend on plan terms. | Read the license for your plan and distribution use. |
| Musicful | Musicful says it retains ownership of generated tracks and grants downloaders a non-exclusive perpetual license; its product information limits commercial use to Standard/Pro plans. | Confirm the plan requirement and the license scope for your use. |
| Tunee | Tunee advertises a full commercial license for generated songs and videos, while free users are limited to personal projects with attribution. | Resolve the plan-specific terms for your account and track; Tunee says copyright law is evolving and does not guarantee copyright protection. |
| AI Jingle Maker | The service says commercial use is included for broadcasts, podcasts, sponsor audio, and audio marketing. | Check its current terms for your particular deliverable and use. |
| OpenMusic AI | The service describes generated tracks as designed for commercial use and says each song comes with a license. | Review that license and confirm the project and distribution are covered. |
| Soundverse AI Beat Maker | The service says a commercial license is available for releasing and monetizing tracks; product information lists commercial licenses under Creator & Pro. | Confirm the plan and license terms for the beat you intend to release. |
A Lower-Risk Creation And Release Workflow
- Define the use. Write down where the audio will appear, whether it will be monetized, and whether it includes a real person’s voice, supplied samples, or material based on an existing song.
- Use a clean brief. Describe musical qualities rather than asking for a named artist’s voice or a near-copy of a known recording. For example: “Create a short, original upbeat audio logo with warm synth tones, a simple rising melody, and a clean ending for a podcast intro.” This is a prompt-writing precaution, not a guarantee of clearance or copyright.
- Check terms before generating or downloading. Confirm the account tier, commercial-use scope, restrictions on voices or supplied material, and any attribution requirement. If those terms do not clearly cover the planned use, ask the service or choose another route.
- Add and document human work. Write or perform original lyrics, record permitted instruments or vocals, and make meaningful arrangement or editing choices. Save drafts and project records; the Copyright Office says only human-authored parts of a mixed work may be protected.
- Review the final audio and upload details. Check for unintended voice likenesses or recognizable borrowed material. Apply the destination platform’s disclosure requirements where they apply, and avoid mass-produced or repetitive uploads if monetization matters.
What A License Cannot Settle
A service’s commercial-use permission does not itself establish that AI-only audio is copyrightable, that a voice or borrowed work was used with consent, or that another platform will accept or monetize the upload. The cited U.S. copyright guidance addresses authorship and registration disclosure; it does not resolve every dispute about training data, similarity, publicity, or laws outside the United States. This guide is general information, not legal advice; check the relevant terms and rules for your project.
