Short answer: An AI-generated track is not automatically copyrightable, and a platform’s commercial licence is different from copyright ownership. In the United States, the Copyright Office says material generated entirely by AI is not copyrightable; prompts alone do not make you the author, while your original human contributions to a mixed work may be protected. A registration application must disclose more than a minimal amount of AI-generated material and describe your contribution. Treat every download as a licensed platform asset unless the service’s terms clearly give you more.
Copyright And A Commercial Licence Are Different
Copyright is a legal right in an original work. A commercial licence is permission from the service to use its output in monetised videos, releases, advertising, games or client work. A licence can let you publish a track even when you cannot claim exclusive copyright in its entirely AI-generated passages.

Keep the prompt, lyrics, uploaded audio, edit history, plan name, download date and licence certificate. If you add original lyrics, a recorded performance, arrangement, or substantial editing, identify those human contributions in your records. A Rights-Safe Workflow For A New Track
- Choose the release use first. Write down whether the track is for a monetised video, podcast, streaming release, advertisement, game or client deliverable.
- Select a plan that explicitly covers that use. Do not treat a free preview, watermarked file or personal-use plan as commercially cleared.
- Use material you control. Write original lyrics, record your own voice, or use audio for which you have permission. Do not upload a sample, vocal or reference recording unless its licence permits AI processing.
- Describe the music without naming a living performer. For example: “Two-minute cinematic electronic instrumental, 100 BPM, minor key, restrained drums, clean ending for a podcast outro.” Then request an alternate arrangement and edit the structure yourself.
- Document human authorship. Save your lyrics, recordings, arrangement decisions, edits and stems so you can describe your contribution if you register the work.
- Export and archive proof. Keep the downloaded file, invoice or plan record, terms version, per-track licence and any certificate before uploading.
- Check the destination’s policy. A platform licence does not override Spotify, YouTube or a client contract.
Voices, Covers And Uploaded Audio Need Extra Care
Do not clone or imitate a recognisable singer without consent. Spotify says vocal impersonation is allowed only when the impersonated artist has authorised it, and it supports AI disclosures in credits. For covers, verify that you have the underlying composition and recording permissions needed for your release; an AI service’s terms do not automatically clear those rights. For uploaded samples or reference audio, obtain permission from every relevant rights holder and check the platform’s processing terms.
When a track could be mistaken for a real person’s performance, YouTube requires an altered-or-synthetic-content disclosure. Its [clarification of inauthentic-content guidance](https://techcrunch.com/2026/07/20/youtube-clarifies-policies-around-ai-slop-and-upsetting-videos/) says the monetisation rule targets mass-produced, repetitive or template-based uploads rather than AI use by itself.

How To Read A Vendor’s Licence Before Publishing
- Find the exact plan named on your receipt, not only the product’s marketing page.
- Check whether “commercial” includes your destination: streaming, advertising, games, client work and paid social may be treated differently.
- Look for ownership, exclusivity, attribution, watermark, download and content-ID clauses.
- Confirm whether voice cloning, covers, reference audio, stems and remixes have separate rules.
- Save the terms and licence certificate that applied on the download date.
What You Can Safely Claim
You can claim your documented human contribution, such as original lyrics, a recorded performance or substantial arrangement, subject to the law where you register. You should not claim that an entirely AI-generated passage is exclusively copyrighted merely because you wrote a prompt or paid for a subscription. If the vendor’s page does not state a needed right, pause publication and ask the vendor for written clarification.

Clear credits and disclosures help keep a licensed release from being mistaken for an unauthorised human performance.
